Tagomoto Terms Of Service

These Terms of Service are an agreement between you and the operator of Tagomoto. They apply when you use the Tagomoto mobile app and related website pages that link to these terms.
Read these terms carefully. By using Tagomoto, you agree to these terms. If you do not agree, do not use Tagomoto.
What Tagomoto Does
Tagomoto is a visual home organization app. It helps you create a grid notebook map of spaces, areas, containers, and items so you can remember where things live.
Tagomoto is a personal organization tool. It is not a professional inventory system, insurance record, safety system, legal record, emergency service, warehouse management system, or guaranteed backup service.
Current Local-First Design
The current iOS app stores your app data locally on your device. It does not require a Tagomoto account and does not currently provide Tagomoto-operated cloud sync.
You are responsible for maintaining your device, device backups, and access credentials. If you delete the app, erase your device, lose access to your device, or do not maintain usable backups, your Tagomoto data may be lost.
Eligibility
You may use Tagomoto only if you can legally agree to these terms. If you use Tagomoto on behalf of another person or organization, you represent that you have authority to do so.
Tagomoto is not directed to children under 13. If you are under the age required to agree to these terms in your location, you may use Tagomoto only with permission and supervision from a parent or legal guardian.
License
Subject to these terms, Tagomoto grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial home organization purposes.
You may not:
- Copy, modify, distribute, sell, rent, lease, sublicense, or host Tagomoto except as allowed by law or platform rules.
- Reverse engineer, decompile, or attempt to extract source code except where allowed by law.
- Use Tagomoto to violate law or the rights of others.
- Interfere with, damage, or misuse Tagomoto or related services.
- Misrepresent your relationship with Tagomoto.
- Use Tagomoto in a way that creates safety, security, legal, or operational risk for others.
Your Content And Data
"Your Content" means information you enter into Tagomoto, such as profile name, space names, area names, container names, item names, notes, quantities, emoji, grid positions, colors, and other organization details.
You are responsible for Your Content. Do not enter information that you do not have the right to use or that would violate someone else's rights.
As between you and Tagomoto, you keep your rights in Your Content. The current app uses Your Content on your device to provide app functionality.
If you send information to Tagomoto through support, website, beta, waitlist, email, or other online channels, you grant Tagomoto permission to use that information to respond to you, provide support, operate and improve Tagomoto, and maintain appropriate records.
Accuracy And Reliance
Tagomoto depends on information you enter and maintain. Tagomoto does not verify that your map, item details, quantities, locations, notes, or reminders are accurate.
You should not rely on Tagomoto as the only record for:
- Emergency supplies.
- Medication.
- Food safety.
- Expensive property.
- Insurance claims.
- Legal records.
- Business inventory.
- Safety-critical items.
Use your own judgment and maintain separate records where needed.
Backups And Data Loss
The current app is local-first. Tagomoto does not guarantee that your data will be recoverable after deletion, device loss, device damage, app removal, operating system errors, database corruption, or failed backups.
You are responsible for any backups available through your device or operating system.
Updates And Changes
Tagomoto may change, suspend, or discontinue features at any time. Updates may add, change, or remove functionality. Some changes may require updates to the Privacy Policy or these terms.
You are responsible for using a supported version of the app and keeping your device software reasonably up to date.
Beta Or Pre-Release Features
If you use a beta, TestFlight, preview, or pre-release version of Tagomoto, you understand that it may contain bugs, incomplete features, data-loss risks, and changing behavior.
Do not use beta versions as your only record for important information.
App Store Terms
If you download Tagomoto through Apple's App Store or TestFlight, Apple's terms, rules, and policies also apply. Apple is not responsible for Tagomoto's content, maintenance, support, warranties, or claims except as required by applicable law or Apple's own terms.
Third-Party Services
Tagomoto may rely on third-party platforms or services such as app stores, device operating systems, website hosting, support tools, email providers, beta testing services, or local database libraries.
Those third parties may have their own terms and privacy policies. Tagomoto is not responsible for third-party services that it does not control.
Intellectual Property
Tagomoto, including its name, design, app interface, illustrations, mascots, icons, text, code, and other materials, is owned by Tagomoto or its licensors and is protected by intellectual property laws.
These terms do not transfer ownership of Tagomoto or its intellectual property to you.
Feedback
If you send ideas, feedback, bug reports, suggestions, or other comments about Tagomoto, you allow Tagomoto to use them without restriction or compensation to you. This helps improve the app while avoiding ownership disputes over product suggestions.
Termination
You may stop using Tagomoto at any time. You may delete the app from your device.
Tagomoto may suspend or terminate access to online services, beta programs, support channels, or future account features if you violate these terms, create risk, or misuse the service. For the current local app, deleting the app is generally the main way to stop using it.
Disclaimers
Tagomoto is provided "as is" and "as available." To the fullest extent allowed by law, Tagomoto disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and data preservation.
Tagomoto does not promise that:
- The app will be error-free or uninterrupted.
- Your data will never be lost or corrupted.
- Search results, maps, quantities, reminders, or locations will always be accurate.
- The app will meet your specific needs.
- The app will be available forever or on every device.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation Of Liability
To the fullest extent allowed by law, Tagomoto and its operators, owners, developers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, device issues, business interruption, or substitute services.
To the fullest extent allowed by law, Tagomoto's total liability for any claim related to the app or these terms will be limited to the greater of the amount you paid to use Tagomoto in the 12 months before the claim or USD $50.
Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you.
Indemnity
To the extent allowed by law, you agree to defend, indemnify, and hold harmless Tagomoto and its operators, owners, developers, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from your use of Tagomoto, Your Content, your violation of these terms, or your violation of law or another person's rights.
Consumer Rights
Nothing in these terms limits rights you may have under laws that cannot be waived by contract. If a term is not enforceable in your location, the rest of the terms remain in effect to the fullest extent allowed by law.
Governing Law And Disputes
The laws that apply to these terms will be the laws of the jurisdiction where Tagomoto's operator is established, unless consumer protection law requires a different rule.
Before filing a formal claim, you agree to try to resolve disputes informally by contacting Tagomoto through the contact method listed where these terms are posted, in the App Store listing, or on the Tagomoto website.
Changes To These Terms
Tagomoto may update these terms from time to time. When the terms change, the effective date above will be updated. Continued use of Tagomoto after updated terms are posted means you accept the updated terms, unless applicable law requires a different process.
